The Terms and Conditions stipulated below incorporates the integral concurrence between the HR Service and mypeopleworks pertaining the utilization of any of the products and services of mypeopleworks' constituting but not confined to the website, transposing any antecedent agreements between the HR Service and mypeopleworks in relation to the utilization of such services and products.

With the utilization of any part or all of the services and products thereof, the HR Service is restrained by these Terms and Conditions.

In the event of failure of mypeopleworks to enforce and/or exercise any right or provision of these Terms and Conditions shall not actualize a waiver of such right or provision in that or any other ground. If any provision of these Terms and Conditions is held invalid, whatever remains of these Terms and Conditions shall persist in full force and effect. If any provision of these Terms and Conditions shall be assumed illegal or unlawful, void or for any reason unenforceable and unattainable, such provision shall be assumed severable from these Terms and Conditions and shall not affect the validity and enforceability of any remaining provisions.

These Terms and Conditions is an Agreement governed by the laws of Philippines and the HR Service hereby submits to the jurisdiction of the courts of Philippines.

1. Definitions

    • mypeopleworks: Shall refer to mypeopleworks or mypeopleworks.com.

    • HR Service: Shall refer to the registered company or party contracting for the services of mypeopleworks.

    • Service: Shall include any service provided by the mypeopleworks, but not confined to:
      • the procurement of online recruitment advertising;
      • the procurement of online resume search access;
      • matching of job specifications with our Job Seekers profiles and suggesting to them of the position availability through email notifications;
      • the procurement of New Employees’ manuals, handbooks and other training materials;
      • the maintenance of Employees’ 201 Files;
      • performance and career evaluation of Employees; and
      • the end of contract documentations of Employees.

2. mypeopleworks shall:

  • follow with all applicable laws and regulations with respect to the procurement of the Service.

  • generate all efforts to publish advertisements on the website within the acceptable and reasonable business timeframe.  mypeopleworks is not liable for any loss or damage brought about by the HR Service as a result of any delay or failure in publishing an advertisement.

  • secure all efforts to avoid errors and misinformation in advertisements. However, mypeopleworks would not be responsible for any errors on any data and specifications and requires that the HR Service check all entries and any other data and/or information for errors, be it typographical or simple negligence as soon as they are placed. Any errors may be edited within one business day from notice by the HR Service.

  • commit its best efforts to make the Products and Services available for access anytime, anywhere.  mypeopleworks shall not be liable for any disturbance of Service although it may undertake remedial efforts make necessary adjustments when appropriate.

  • provide its best efforts to retain the job advertising of the HR Service and resume of Job Seekers related to the job advertising and/or resume search in the for a period identifiable and customizable by the HR Service.  Subsequent to the timeframe agreed upon by both parties, mypeopleworks reserves the rights and discretions to remove all such information and data at any time without prior notification and reasons.

  • Procure Manuals for New Employees, handbooks and training materials and be able to come up with a customized materials according to the needs of the HR Service.

  • Maintain and secure all Employees’ 201 Files.  All files shall be made available as needed by the HR Service.

  • Periodic Evaluation of Career and Performances of all Employees shall be made readily available.

  • Documentations of Employees for End of Contract shall be procured.

  • All HR Documents and Reports shall be made available when needed and may be generated whenever and wherever the HR Service deems its utilization.  Notifications shall be sent to the registered email address every step of the way to assure security of the account.

3. The HR Serive shall:

  • at all times ensure they comply with all applicable laws and regulations.
  • comply with all notices, instructions and communication given or sent by mypeopleworks with regards to the use of the Service.
  • assure that all data and information made through mypeopleworks are for legitimate and lawful practices for which the HR Service has permission seek and gather such; and
  • shall not divulge confidential information achieved through the use of the Service to any third party, and
  • shall not utilize any data and information gathered from the use of the Service for any purpose whatsoever other than for the purpose of employment and HR Services and Documentation.
  • certify that any data and information achieved as a result of the use of the Service will not be used for solicitation to the Job Seeker or any other third party for purchase of products and/or services, collection of database information for use or sale which are not authorized , disclosure to any third party, contact with the user for any purpose other than potential employment and HR Services and Documentation, or any other purpose which is not consistent with mypeopleworks’ privacy policy and these terms of use.
  • shall not use the Service to redirect user traffic and/or user resumes and all its data and information to the HR Service’s own website or any other third party website.
  • provide and maintain accurate, complete and current data required to register to mypeopleworks.
  • not contradict on the intellectual property rights of any person or company including mypeopleworks or download, copy and circulate information obtained through use of the Service with the intention to do so.
  • not allow or transfer to any third party the right to access the Service under their account without the prior written consent of mypeopleworks.
  • be maturely and totally responsible for the maintenance of safety and security of any user ID’s and/or passwords provided to them to access the Service.
  • not use the system for any illegal purpose consisting of, but not confined to, introducing and/or transmitting any data or program containing any form of computer virus.
  • not send any information or communication of any type using the system which may contain malicious and/or illegal materials and contents.
  • agree to defend and hold mypeopleworks not liable to, from and against any claims, actions or demand, which may result from the HR Service’s use of the Service or breach of the Terms and Conditions.

4. Payment of Fees

4.1)       Any and all of the amounts owed to mypeopleworks must be completely paid within the specified payment terms agreed upon. mypeopleworks reserves the right to charge interest or any additional charges on any late payments and violations on the agreement.

4.2)       Prices of Products and Services may change at any time without prior notice. HR Service shall not be entitled for any rebate or discount unless otherwise specified; on previously agreed upon contracts as a result of changes to the pricing.

4.3)       HR Service shall be accountable for full payment of Products and Services fees from the commencement of the contract. Payment should be made notwithstanding any errors or omissions in the incurred data.

4.4)       All of the prices quoted are exclusive of any applicable taxes of the Republic of the Philippines unless specifically noted otherwise.

5. Suspension

5.1)       Without predilection to any other rights, mypeopleworks reserves the right to suspend HR Service’s account with the suspension of access to any and all aspects of its Products and Services should there be an event of non-payment of dues in full in compliance with the previously agreed upon payment terms.

5.2)       Without prejudice to any other rights, mypeopleworks reserves the right to suspend access to any and all aspects of its Products and Services without refund should the HR Service exercise and maintain non-compliance with these Terms of Use.

6. Disclaimers

6.1)       mypeopleworks shall not be responsible for any loss and misrepresentation of information/data however it may be caused; be it as a result of any suspension, termination and/or interruption of the Service.

6.2)       mypeopleworks makes no representations and warranties of any kind for the Services and in relation to the accuracy or quality of any information transmitted or obtained through the Service. Governed and permitted by law to its fullest extent, mypeopleworks does not claim any representation or warranty, be it expressed or implied, as to the title, fitting for a particular purpose, merchantability, accuracy or standard of quality of the Services and/or any contents of the database, and no guarantee whatsoever is given that the Service shall be uninterrupted or would not contain and obtain any error, or in relation to the database content gathered or to be gathered from or through the use of mypeopleworks and/or the Products and Services of which unless otherwise specifically mentioned in this agreement.

6.3)       mypeopleworks shall not be held responsible for any loss or damages brought about by any disclosure (inadvertent or otherwise) of any data and/or information concerning the HR Service’s account and particulars nor for any error, omission or inaccuracy with respect to any information so divulged nor does it acknowledge and endorse any opinion expressed by any other HR Service.

6.4)       mypeopleworks does not guarantee that its operation and the processes of mypeopleworks.com will be free of any operational errors and disturbances nor that it will be free of any computer virus.

6.5)       The HR Service acknowledges that it is not mypeopleworks’ policy to edit any supplied and given data and information and contents that may be made available through the Service.

 

 

7. Use of Data

The HR Service hereby agrees and beyond any doubt authorizes mypeopleworks to:

7.1)       use any data and information supplied by the HR Service for mypeopleworks own marketing and internal purposes; thus agreeing therefore that mypeopleworks and any of its acknowledged companies and/or third parties to use for such purposes which has been deemed necessary for the operation of mypeopleworks.

7.2)       allow the retention all data and information supplied by the HR Service in using the Products and Services at mypeopleworks for the use of the website, regardless of  the termination or suspension of the Service to the HR Service herein.

8. Indemnity

The HR Service shall indemnify and make mypeopleworks harmless at all times against all actions, proceedings, costs, claims, expenses, demands, liabilities, losses and damages including without limiting such for defamation, infringement of intellectual property rights, death, bodily injury, property damage or pecuniary losses howsoever arising which mypeopleworks may sustain, incur, suffer or pay arising out of or in connection with the use of the Products and Services by the HR Service.

9. Termination

This Terms and Conditions and any other similar in nature agreement may be terminated, at any time, by mypeopleworks with prior written notice to the HR Service if it is found that the HR Service makes use of such Products and  Services in any way or manner that may affect, limit or compromise the interest or business of mypeopleworks. No refund, compensation or consideration will be merited to the HR Service should such events transpire.

10. Privacy

mypeopleworks has a principal concern in the mature, responsible and lawful use of information that users and clients share and disclose.

11. Variation

11.1)     mypeopleworks reserves all the right to amend and change the terms and conditions contained herein at any time without prior notice to the HR Service.

11.2)     The HR Service’s continuity in the utilization of mypeopleworks’ Products and Services following any amendments confirms its acknowledgement of such amendments thus making the Job Provided governed and bound by the Terms and Conditions herein as varied or amended.

 

 
12. Refund Policy

12.1)     A compulsory Preview of any data and information feature is provided for all mypeopleworks processes before payments are made, thus, request for refunds will not be entertained.

12.2)     All information applying to mypeopleworks’ paid Products and Services for HR Service shall be made available upon request from mypeopleworks.  HR Service may contact mypeopleworks Sales Team before making a purchase for all their required information. All HR Service is fully advised to make their own informed decision before they purchase any of mypeopleworks’ Products and Services. Refunds will be considered at the sole discretion of mypeopleworks, should the HR Service decide later to withdraw their purchase.

13. Rights and Discretion

13.1)     mypeopleworks reserves all the right and discretion to remove any or all data and information without any reason, any prior notice and with no refund. 

13.2)     mypeopleworks has the right to make relevant enquiries of HR Service to satisfy any issue raised by management or users of mypeopleworks to ensure that all data and information supplied and posted on the website are made in good faith and in compliance with the above policy, and make void the registration of HR Service who do not comply.

13.3)     Determination of compliance with the Terms of Use is the sole right of mypeopleworks.
